Dept. of Homeland Security (DHS) New Public Charge Rule Effective Today, February 24, 2020

On Friday, February 21, 2020, the U.S. Supreme Court allowed the DHS public charge regulation — which institutes a racially-motivated wealth test in the U.S. immigration system — to take effect nationwide, by removing the last injunction standing in Illinois. The regulation is scheduled to take effect nationwide starting TODAY, February 24, 2020, while the litigation proceeds in the lower courts. The State Department’s parallel public charge regulation, which governs how the test is implemented abroad, is also set to go into effect today.

We want our immigrant communities to be informed. Here are some fast facts:

  • Public Charge does NOT apply to most immigrants. Every family is different, and the public benefits that you receive or are eligible might not be affected by the new Public Charge rule.
  • Talk to a trusted immigration attorney before making ANY changes to public benefits that you receive or have applied for. Do NOT disenroll in your public benefits unless advised to by an attorney.
  • The final rule will only apply to immigration applications and petitions submitted on or after February 24, 2020. If you have submitted an application or petition before February 24, 2020, the new Public Charge rule will NOT be considered in your application.
